AJIT Vs. ADDITIONAL DISTRICT JUDGE, BULANDSHAR AND OTHERS

JUDGEMENT

(1.) Heard learned Counsel for the parties.

(2.) This is tenant's writ petition arising out of eviction/release proceedings initiated by original landlord-respondent No. 3 Pyarelal, since deceased and survived by Legal representatives, on the ground of bona fide need under Sec. 21 of U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 in the form of R.C. No. 5 of 1985.

(3.) Property in dispute is a shop rent of which is Rs. 45/- per month. In the release application original landlord stated that he had five sons of which Radhey Lal and Deena were not having any shop to do their business. It was further stated that the shop was specifically required for settling Deena in business, who was married and was having children. It was also stated that Deena was selling ground nuts on Thela (hand card) and earning hardly Rs. 10.00 per day.
