JUDGEMENT

(1.) WE have heard learned Counsel for the appellant and learned AGA.

(2.) THE applicant had obtained bail on 4.3.2003 when his appeal against his conviction and sentence to imprisonmen for life and a fine of Rs. 5,000/ - under sec tion 302/149 IPC; to 10 years' RI and a fine of Rs. 2,000/ - under section 326/149 IPC; to one year's RI under section 147 IPC, wa: admitted by Hon'ble I.M. Murtuza, J. Hi has now moved an application on 31.1.2007 praying that the conviction awarded to hin be stayed in view of the decision of th Apex Court passed in Crl. Appeal No. 59 of 2007: Navjot Singh Sidhu v. State of Punja and others which was decided on 23.1.20C and whose copy has been annexed with tr affidavit to the application.

(3.) WE think that the appellant cam be granted the prayer made by this belat application.
