JUDGEMENT

(1.) THIS writ petition has been filed by the petitioner Dr. Om Prakash Tripathi and Shiv Prasad for quashing the FIR registered at police station Bhatpar Rani, District Deoria on 1-12-2006 at crime No. 370 of 2006 under Sections 409, 467, 468, 469, 471, 420, IPC. They have further prayed for directing the Investigating Officer not to arrest them in connection with the said F. I. R.

(2.) WE have heard Shri Arvind Kumar Shukla, learned Counsel for the petitioner and learned AGA for the State. None appears for the respondent No. 3.

(3.) WE are not going to the conduct trial in the matter. For a moment, if it is believed that the F. I. R. has been lodged under the pressure of someone even then it is to be seen by the Investigating Officer whether the offence alleged in the F. I. R. is made out and if the offence is made out, it is meaningless that on whose instance the F. I. R. has been lodged.
