JUDGEMENT

(1.) THE petitioner informs that before filing of this writ petition, he had filed a petition in the Hon'ble Apex Court bearing writ petition No. C -89 of 2005, Dr. Subramanian Swamy v. Election Commission of India and Ors. and the same was dismissed in -limine on 11.04.2005 and accordingly the instant writ petition has been preferred under Article 226 of the Constitution of India.

(3.) THE petitioner claims that the information is false and he could come to know about the same through media. The petitioner made a representation (annexure -3) to the Chief Election Commissioner. Thereafter on 1.7.2004, respondent No. 1 forwarded the complaint to the Returning Officer concerned for proper action. Respondent No. 2 thereafter fixed a date 8.10.2004 for personal meeting.
