JUDGEMENT

(2.) BY the present A. O. filed under section 173 of the Motor Vehicles Act, 1988, appellant has prayed for setting aside the award dated 5. 10. 2002 passed by the Motor Accident Claims Tribunal/district Judge Almora in Motor Accident Claim Petition No. 18 of 2002 Kundan Singh v. Nanda Ballabh Pandey whereby the claimant has been awarded a sum of Rs. 39,560/- towards compensation along with interest @ 9% per annum.

(3.) BRIEFLY stated, a claim petition was filed by the claimant-respondent No. 1 being Motor Accident Claim Petition No. 18 of 2002 Kimdan Singh v. Nanda Ballabh Pandey claiming a sum of Rs. 40,000/- along with interest @ 12% per annum.
