JUDGEMENT

(1.) The instant criminal revision has been preferred by the accused revisionist ? Nand Kishore Singhal against the order dtd. 11/3/2025 passed by the Additional Chief Judicial Magistrate, Firozabad in Criminal Case No. 760 of 2023 (State Vs. Pooran Singh and others), arising out of Case Crime No. 312 of 2021, under Ss. 419, 420, 467, 468, 471 of I.P.C., Police Station Sirsaganj, District Firozabad whereby he was summoned to face trial under Ss. 419, 420, 467, 468, 471 of I.P.C. I.P.C. on an application moved by the prosecution.

(2.) Heard Shri Pradeep Kumar Yadav, learned counsel for the revisionist, Shri Arpit Dubey, learned counsel for the opposite party nos.2 to 5 as well as Shri C.B. Dhar Dubey, learned A.G.A. for the State and perused the record.

The facts of the case, as unfolded in the F.I.R., which was lodged by the informant Siyaram Sharma on 1/6/2021 at 5.30 p.m. under Ss. 419, 420, 467, 468, 471 of I.P.C. are that on 29/5/2021 villagers informed the informant that he had sold his agricultural land. The informant denied having sold any land, however, harboring suspicions, he visited the Sirsaganj Tehsil office on May 31, 2021, to conduct an inquiry. Upon doing so, the informant discovered that an unidentified individual by fraudulently utilizing the informant's Aadhaar Card had executed a forged Sale Deed for the informant's agricultural land (Plot No. 370) in the name of Manish Agarwal, son of Ram Prakash, resident of Tehsil and District Auraiya. In this forged Sale Deed, the identities of both the buyer and the seller were attested to by Puran Singh and Sumit Kumar, residents of the informant's village. Furthermore, the said forged Sale Deed was executed by the deed writer, acting in criminal conspiracy with all the aforementioned buyers, sellers, and witnesses with the specific intent of usurping the informant's agricultural land and subsequently, an application for mutation had been submitted to the Tehsildar of Sirsaganj.
