SABHAJEET YADAV Vs. STATE OF U.P.

JUDGEMENT

(1.) Petitioners' case is, whether the directions passed by a Division Bench of this Court in the case of Dr. Vishwajeet Singh and others vs. State of U.P. and others, 2009(2) ESC 1387 (DB) as upheld by Supreme Court, were strictly followed or not. For reference the directions passed in Dr. Vishwajeet Singh (supra) are reproduced hereinafter:

(2.) An appeal against aforesaid judgment was dismissed by Supreme Court vide order dtd. 19/1/2017 passed in Civil Appeal No. 6385-6386 of 2010.

(3.) Subsequently this matter was referred to a Full Bench of this Court in the case of Dr. Archana Mishra and others vs. State of U.P. and others, 2018(10) ADJ 487 wherein also the decision in Dr. Vishwajeet Singh (supra) was further approved. For reference para 33 of Full Bench judgment is reproduced hereinafter:
