JUDGEMENT

(1.) The defendant/applicant has approached this Court assailing the order dated 16 Dec. 2015 passed by the Revisional Court in Civil Revision No. 171 of 2015 arising from an order passed by the trial Court in Original Suit No. 298/2010 (Satish Kumar and another Vs. Dharamveer Singh), whereby the application to recall the order dated 18 Oct. 2011 to permit the applicant/defendant to file written statement has been rejected. The Reivisional Court in the impugned order noted as follows:-

(2.) The Revisional Court rejected the application after placing reliance upon the judgment rendered in Salem Advocates Bar Association Tamilnadu Vs. Union of India [(2005) 6 SCC 344] and Kailash Vs. Nankhu [AIR 2005 SC 2441] .

(3.) Submission of the learned counsel for the applicant is that the applicant may be given an opportunity to file written statement.
