JUDGEMENT

(1.) Both these cases arise out of a common judgment, hence both the aforesaid cases are being disposed of together by a common judgment.

(2.) Criminal Appeal No. 1578 of 2008 has been preferred by convicted appellant Pulli while Criminal Revision No. 499 of 2008 has been preferred by P.W. -2 Mahanand, who happens to be father of deceased Raju challenging the acquittal of remaining four accused persons.

(3.) Heard Mr. R.B.S. Rathore, learned counsel for the appellant, Mr. Umesh Verma, learned A.G.A. for the State, Mr. Shafat Ullah Khan, learned counsel for the complainant and perused the lower court record.
