JUDGEMENT

(1.) Heard Sri Raj Kumar Kesari, counsel for the appellants, Sri Amit Pathak, counsel for the respondents and perused the records.

(2.) Present appeal has been preferred against the judgment dated 9.2.2016 passed by Additional District Judge, Court No.-4, Varanasi in Civil Appeal No. 128/2009, Pramod Kumar Vs. Raj Kumar and others.

(3.) Admitted case of the parties has been that plot no. 69 of village Laxmanpur is in ownership of plaintiffs, and the plot no. 72 of said village is in ownership of defendants. Plaintiffs had filed suit for permanent injunction against defendants for restraining them from interfering in his possession over plot no. 69. Thereafter, he also sought relief of removal of defendants' construction present on plot no. 69 which were detailed in plaint map by letters 'Ka, Kha, Ga, Gha', the wall shown by letters 'Cha, Chha' and the construction shown by letters 'Ta, Tha, Da, Dha'.
