(1.) Heard learned counsel for the parties and perused the record.
(2.) The concurrent findings of fact recorded by both the courts below in a proceeding under Sec. 21(1)(a) of U.P. Act No. 13 of 1972 are under challenge in the present writ petition.

The landlord namely Sri Bharat Bhaskar Srivastava filed a release application in the year 2011 stating therein that he had purchased the House No. 104/348, Prem Nagar, Sisamau, Kanpur Nagar through a registered sale deed dated 25.7.2007 executed by Sri Gopal Das. There are three members in his family including himself. He is engaged in a scrap business and her wife is doing tailoring work. His son was studying B.Tech.
