JUDGEMENT

(1.) Sri Brij Mohan Sahai, learned counsel for the appellant and Sri Umesh Verma, learned Additional Government Advocate were heard at length.

(2.) Under challenge in the instant criminal appeal is the judgment and order dated 18.04.2007 passed by learned Additional Sessions Judge, Court No.17, Lucknow, in Sessions Trial No.46 of 2005, arising out of Case Crime No.110 of 2004, Police Station Maal, District Lucknow, whereby the appellant Rakesh Kumar was convicted and sentenced as under:-
