JUDGEMENT

(1.) Heard Sri M.D. Singh Shekhar, Senior Counsel assisted by Sri S.C. Pandey who appears for the petitioner, learned Standing Counsel and Sri Pankaj Agarwal, learned counsel for respondent No.3.

(2.) This petition under Article 226 of the Constitution of India has been filed for quashing of the order dated 10.3.2016 passed by the Sub -Divisional Officer, Tehsil Gabhana, district Aligarh in election proceedings initiated in relation to the election of a Gram Pradhan. The other reliefs in the writ petition are for rejecting application dated 10.3.2016 of respondent No.3 and for a direction to the authorities to handover charge of Gram Pradhan to the petitioner.

(3.) The order impugned, Annexure ­ 8 to the writ petition has been passed on the application of respondent No.3. It only directs that the order dated 8.3.2016 passed earlier shall remain stayed till the recall/review application of respondent No.3 is heard for which 28.3.2016 was fixed after directing for issuing notice to the petitioner.
