JUDGEMENT

(1.) Heard counsel for the parties and perused the record.

(2.) Brief facts of the case are that the respondent is the tenant of the disputed shop on monthly rent of Rs. 100.00. The petitioner filed a suit for rent ejectment and mesne profit before the trial Court. The trial Court vide order dated 5.3.83 dismissed the suit. Aggrieved the petitioner filed a revision against the order dated 5.3.83 before the Additional District Judge, Aligarh which was allowed vide order dated 12.9.85 remanding the case to the trial Court.

(3.) After remand the trial Court decreed the suit vide order-dated 16.10.98.
