(1.) PETITIONER 's father died in harness on 17.7.1985. Petitioner filed Civil Misc. Writ Petition No. 1790 (S/S) of 1998 for appointment on compassionate ground. Directives were issued for consideration of his claim, said claim was rejected on 8.10.1998. Petitioner has approached this Court requesting therein that he offered appointment in view of judgment rendered by this Court in the case reported in 2005 (2) ESC 1423, Dharmendra Singh v. State of U.P and others.
(2.) SRI Shyam Ji Gaur, learned Counsel for petitioner, contended with vehemence that in the present case, as petitioner's father died in harness, as such in eventuality petitioner is entitled to be offered appointment on compassionate basis in view of aforementioned judgment.
(3.) AFTER respective arguments have been advanced, undisputed position which is emerging is that father of petitioner died on 17.7.1985. About more than 20 years period have already elapsed since the date of death of his father. Petitioner claim in the past was rejected on 8.10.1998. Petitioner has placed heavy reliance on judgment rendered in the case reported in 2005 (2) ESC 1423. Dharmendra Singh v. State of U.P., and others, said judgment will not come to the rescue of petitioner on account of fact that more man 20 years period have already elapsed.
