JUDGEMENT

(1.) This is an application for bail moved on behalf of the applicant Bechey involved in case Crime No. 8 of 2006 under sections 147, 148, 149, 302 I.P.C. and Sec. 7 of Criminal Law Amendment Act, Police station Aliganj, district Bareilly.

(2.) Heard Sri Kamlesh Kumar Singh, learned counsel for the applicant, learned A.G.A.and have perused the record.

(3.) The learned counsel submitted that in the first information report the role of catching hold of the victim has been assigned to the applicant. The learned counsel submitted that informant in his statement recorded under Sec. 161 Crimial P.C. has assigned the same role to the applicant. The learned counsel argued that the witness Ram Singh for the first time disclosed that the applicant has opened fire at the victim.
