HABEEB ULLAH Vs. ABDUL WAHEED AND ANOTHER

JUDGEMENT

(1.) IT appears that Civil Misc. (Abatement) Application No. 215055 of 2006 has been filed on behalf of the defendant -respondent No. 1 (Abdul Waheed). The aforesaid abatement application is accompanied by an affidavit, sworn on 10th October, 2006.

(2.) IT is, inter alia, stated in the said affidavit that Habeeb Ullah (plaintiff -appellant) died on 1st April, 2006 leaving behind several heirs and legal representatives; and that considerable time has elapsed but the heirs and legal representatives of the deceased Habeeb Ullah (plaintiff -appellant) have not come forward to get themselves substituted in his place in the instant second appeal.

(3.) PURSUANT to the said order dated 11th December, 2006, the Office has submitted its report dated 15th December, 2006.
