JUDGEMENT

(1.) IT appears that Civil Misc. (Abatement) Application No. 62629 of 2000 has been filed on behalf of the defendant -respondent No. 2 after serving a copy thereof in the Office of Sri M.A. Zaidi, learned Counsel for the plaintiff -appellant on 8th August, 2000. The aforesaid Abatement Application is accompanied by an Affidavit sworn on 6th August, 2000.

(2.) IT is, inter -alia, stated in paragraph 3 of the said Affidavit that Nisar Ahmad (plaintiff -appellant) had died on 25th June, 1999.

(3.) IT is, inter -alia, further stated in paragraph 4 of the said Affidavit that till date, no Application to bring on record the heirs and legal representatives of the said Nisar Ahmad (plaintiff -appellant) has been filed.
