GOPAL DAS Vs. SRI RAM JANKI MANDIR (RAMGHAT)

JUDGEMENT

(1.) CASE has been taken -up in the revised list. Learned Counsel for the applicant in Civil Misc. Substitution Application No. 85132 of 2006 is not present. It appears that the aforementioned substitution application has been filed consequent to the death of Gopal Das (defendant -appellant). It is, inter -alia, alleged in the affidavit accompanying the aforementioned substitution application that the said Gopal Das (defendant -appellant) died on 2.3.2006.

(2.) BY the order dated 13.4.2006 passed by the Joint Registrar, notice was directed to be issued on the aforementioned substitution application.

(3.) HOWEVER , it appears that requisite steps pursuant to the said order dated 19.7.2006 have not been taken and, therefore, the case has been listed before the Court under Chapter -XII, Rule 4 of the Rules of the Court.
