SUBHASH CHANDRA Vs. MITHILIESHWATI AND OTHERS

Decided On March 15, 1995
SUBHASH CHANDRA Appellant
V/S
Mithilieshwati And Others Respondents

JUDGEMENT

(1.) This revision by the husband has been directed against the judgment and order dated 19.10.94 passed' by Judge Family Court Meerut in Case No. 726 of 1991 under Sec. 125 Criminal Procedure Code awarding Rs. 500.00 as maintenance allowance to opposite party No. 1 who is admittedly the legally wedded wife of the revisionist.

(2.) The two points urged in this revision are that the revisionist never neglected or treated cruelly or refused to maintain her and secondly the revisionist is not possessed of sufficient means to pay her maintenance.

(3.) As regard the second contention it was argued that the revisionist was married while he was a minor that he is still reading in Yashwant Rao Chavan College of Engineering Nagpur and therefore not in a position to pay maintenance allowance.
