JUDGEMENT

(1.) THE main contention raised in this petition is that the learned Sessions Judge, Unnao did not spell out reasons while transferring the case from the court of the III Additional Sessions Judge, Unnao to the court of VII Additional Sessions Judge, Unnao. I have perused the order. The copy of the application for transfer has also been attached. It may be added that the order has to be read in the light of the allegations made in the complaint. The learned Sessions Judge after considering the allegations and bearing in mind the paramount principles of justice transferred the case to the court of the VII Additional Sessions Judge, as such it cannot be said that the order is not a speaking order. It is not necessary that a detailed judgment should be written in the matter of transfer of case from one court to another. The order should only indicate that the judge exercising the powers had applied his mind to the facts and circumstances of the case. I have no hesitation in observing that the learned judge in order to maintain the reputation of the judiciary in the eyes of the people after going through the allegations thought it desirable that the case be transferred from the court of the III Additional Sessions Judge to the court of the VII Additional Sessions Judge. There is no error, in my opinion, warranting interference with the order dated 14 -11 -1984.

(2.) THE revision accordingly fails and is dismissed.
