JUDGEMENT

(1.) HEARD learned counsel for the petitioner, learned Standing Counsel appearing for the State -respondents no.1 and 2 and Sri Sunil Kumar Singh, learned counsel appearing for respondents no.3 and 4.

(2.) THE petitioner is claiming compassionate appointment upon the death of his father, who was an Assistant Teacher in a Primary School run and maintained by the Basic Education Board. His father died on 24.2.1990.

(3.) IT is claimed that at the time of death of the petitioner's father he was a minor and, therefore, could not apply. Now he has attained the majority and is qualified and as such, he is entitled for appointment under the provisions of U.P.Recruitment of Dependents of Government Servants Dying -in -Harness Rules, 1974 (in short the Rules) applicable to Primary Schools.
