JUDGEMENT

(1.) HEARD learned counsel for the petitioner and learned Standing Counsel.

(2.) THE petitioner is seeking quashing of the order dated 24.12.2014 passed by the District Inspector of Schools whereby he has rejected the representation of the petitioner for promotion on the post of Assistant clerk in the institution in question.

(3.) BRIEF facts giving rise to the present writ petition are that the petitioner is working as a class IV employee. The head clerk of the institution has retired on 31.7.2013. One Sandip Tiwari was appointed as head clerk. There are two vacancies on the post of Assistant clerk in the institution in question. Against one vacancy the petitioners name was proposed for promotion in a meeting of the Committee of Management held on 23.2.2014. The papers were forwarded to the District Inspector of Schools on 28.2.2014. The District Inspector of Schools passed an order on 22.4.2014 refuting to grant approval to the promotion of the petitioner stating therein that there was no vacant post of class III employee in the 50% promotion quota.
