JUDGEMENT

(1.) Heard Sri Utpal Chatterji, learned counsel for the revisionist and Sri Ashish Kumar Singh, learned counsel appearing for the respondent.

(2.) This revision has been filed against the order of the Judge Small Causes dated 20.01.2015 in S.C.C. Suit No. 09 of 2011. The aforesaid suit has been filed by the respondent landlord for arrears of rent and ejectment of the applicant from the premises in question.

(3.) Written statement was filed on 01.08.2011 controverting the plaint allegation of title over the premises. In paragraph 12 of the written statement, a clear stand has been taken that the plaintiff is not the owner of the property and, therefore, the suit is not maintainable. It has further been stated that the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972 is not applicable.
