JUDGEMENT

(1.) SANJAY Kapur son of Late D.K. Kapoor, being the informant of Case Crime No.585/14 under Section 420 I.P.C., P.S. Hazratganj, District Lucknow, has preferred this petition for issuance of a writ in the nature of mandamus directing the investigating agency to transfer the investigation of the case.

(2.) THE petition further claims a writ directing the investigating agency to conduct fair and proper investigation in the matter.

(3.) BEFORE we embark on the issue whether the petitioner is entitled to a direction, as prayed for, we would like to mention that in the First Information Report, there are allegations against officers of company, namely M/s Bayaweaver Limited and Space Turtle Private Limited (a Division of BOP Pvt. Ltd.) of mis -management; mal -administration; non -payment of dues to private parties; indulgence of the officers of the company in over spending; non -payment of loans due to private persons; proximity of the company officers with the present and former Chief Minister of U.P., and not having licence/ permission/no objection certificates from various departments.
