JUDGEMENT

(1.) HEARD Sri Arun Kumar Singh learned counsel for the petitioners and learned counsel for the respondents.

(2.) THIS writ petition arises out of proceedings under Section 12 of the U.P. Consolidation of Holdings Act . Mutation was claimed on the basis of a sale deed executed by Smt. Ganga Dei in favour of the petitioner after having obtained permission for the same under Section 5 (1) (C ) II of the U.P. Consolidation of Holdings Act.

(3.) THE objection of the petitioner under Section 12 was contested by Ganga Dei on the allegation that she had not executed any sale deed in favour of the petitioners and that she did not apply for permission for executing the sale.
