JUDGEMENT

(1.) HEARD Sri Diwakar Singh, learned counsel appearing for the petitioner and learned Standing Counsel for the State.

(2.) THE petitioner claims to have been appointed against a sanctioned class IV post in the respondent no. 5 -institution pursuant to selection held against 4 advertised vacant posts.

(3.) THIS fact has been denied in the counter affidavit and it is stated therein that there were only 14 sanctioned class IV posts in the institution, out of which, only 3 posts were found to be vacant by the Divisional Committee.
