JUDGEMENT

(1.) THIS jail appeal has been filed by the appellant Gyani alias Gyan Singh alias Rajesh through the Senior Superintendent, Central Jail, Fatehgarh and it has been registered as Jail Appeal No.4240 of 2009.

(2.) THIS appeal was admitted on 22.7.2009 after condonation of delay. Since the appellant was not represented by any counsel, Ms. Suman Sirohi, advocate was appointed as Amicus Curiae to present his case in Court. The information in this regard had also been sent to the accused -appellant.

(3.) THE accused -appellant has been convicted vide judgment and order dated 23.11.2004 passed by Special Judge (N.D.P.S. Act), Kanpur Dehat in Sessions Trial No.20 of 2002 (State Vs. Gyani alias Gyan Singh) under Section 20 (B) (2) (C) N.D.P.S. Act and sentenced to undergo rigorous imprisonment for 12 years and also a fine of Rs.1 lakh and in default of payment of fine, 1 year additional R.I. has been awarded against the appellant.
