JUDGEMENT

(1.) HEARD Shri B.D. Mandhyan, learned Senior Advocate assisted by Shri Om Prakash Lohia for the petitioner and Shri Sanjay Goswami for the State -respondents.

(2.) THIS writ petition arises out of proceedings under the U.P. Imposition of Ceiling on Land Holdings Act 1961 and is directed against the orders passed by the prescribed authority and the appellate authority, namely, Additional Commissioner, Meerut Division, Meerut passed on 13.11.1986 and 23.02.1988, respectively.

(3.) NOTICES under Section 10 (2) of the Act were received by the petitioner to show cause why 1.430 hectares of land be not declared surplus. The petitioner filed his objection and the Prescribed Authority thereafter by the order dated 13.11.1987 declared 1.3524 hectares of land as surplus.
