RAKESH Vs. TEHSILDAR (JUDICIAL) TEH TANDA, DISTT FAIZABAD

JUDGEMENT

(1.) THIS writ petition has been filed for a writ of mandamus commanding Tehsildar (Judicial), Tehsil - Tanda to decide the application filed under Section 34 of the U.P. Land Revenue Act.

(2.) I have heard Sri M.R. Yadav, learned counsel for the petitioner and Sri Z.Jilani, learned Additional Advocate General for respondent -State.

(3.) BRIEFLY stated facts are that application for mutation was moved in the year 1997 on the basis of registered will. However, said application could not be decided so far. Feeling intrigued over long delay taken in deciding the summary proceedings, an affidavit was called from the Board of Revenue on 16.05.2013.
