JUDGEMENT

(1.) HEARD Sri S.K. Pundir, learned counsel for the petitioner, learned Standing Counsel and Sri G.D. Mishra, learned counsel holding brief of Sri A.K.S. Bais, learned counsel for the respondents.

(2.) THIS writ petition is directed against the order dated 5.11.2014 passed by the District Judge, Saharanpur in Civil Revision No. 121 of 2014 under Section 12 C(6) of the Panchayat Raj Act.

(3.) BRIEF facts relevant to decide the controversy are that in an election of Gram Panchayat Pakhanpur, respondent No.4 Smt. Poonam was declared elected. The petitioner being an unsuccessful candidate filed an election petition no. 3 of 2010 under Section 12 C of the Panchayat Raj Act(in brief "the Act").
