JUDGEMENT

(1.) Heard Sri R.C. Singh, Counsel for the Petitioner and Sri Namwar Singh, Counsel for the Respondent.

(2.) The writ petition arises out of proceedings under Section 9A (2) of the U.P. Consolidation of Holdings Act.

(3.) The writ petition seeks quashing of the orders dated 16.10.1981 and 29.12.1983 passed by Assistant Settlement Consolidation Officer and Deputy Director of Consolidation respectively. The dispute in the writ petition pertains to 7 decimal of plot no. 851 of Village & Post Bhuswal, District Gorakhpur. The total area of the plot is 14 decimal, 7 decimal was recorded in the name of Shiv Balak in the basic year award. This area is not in dispute. Of the remaining 7 decimal of this plot, 3 decimal was recorded in the name of Raj Bali while 4 decimal was recorded as Matrook in the basic year.
