JUDGEMENT

(1.) THIS revision has been preferred by Ramesh Chandra against the order dated 4-2-97 passed by Commissioner, Kanpur Division, confirming the order passed by Collector Etawah.

(2.) THE opposite party despite sufficient service is not present. I have heard the learned Counsel for the revisionist and D.G.C. (Revenue) and gone through the record.

(3.) WITHOUT expressing any opinion it is a fit case for remand. Revision is allowed, orders of the Courts below are set aside and the case is remanded back to the Collector Etawah for its disposal according to the procedure laid down in the Act, after affording opportunity of hearing to the parties. Revision allowed.
