JUDGEMENT

(1.) Heard Shri R.P. Agarwal, learned counsel for the respondent company, and Shri S.K. Saxena, official liquidator, present in court.

(2.) This company petition was registered upon a reference from the Board for Industrial and Financial Reconstruction (BIFR) under Sec. 20(1) of the Sick Industrial Company (Special provisions) Act, 1985, by which the Board, after conducting enquiry under Sec. 16 of the Act, recommended, vide its order dated 5.1.2004, in Case No. 149 of 1994, that J.K. Jute Mills Ltd. with its registered office at Kamla Tower, Kanpur, the respondent company, be would up by the court.

(3.) Notices were issued by this court in the matter on 1.4.2004 to the respondent company.
