JUDGEMENT

(1.) BY means of this Writ petition, petitioner seeks a writ in the nature of mandamus commanding the respondents to allow the petitioner to continue on the post of Assistant Lecturer in Civil Engineering on ad hoc basis in Government Polytechnic, Orai at Jalaun till duly selected candidate through U.P. Public Service Commission is not available, and for other incidental relief's. While going through the writ petition, we find that no counter affidavit has been filed on behalf of the respondents, as such this court has no option but to proceed with the case, on the assertions made by the petitioner in the instant writ petition, and, the respective arguments advanced on behalf of the learned counsel for the parties.

(3.) DURING the period of one year, another letter of appointment was issued being No. 727 -30/X -25 P.F. dated July 19, 1988, by which the petitioner was regularly appointed on the post of Assistant Lecturer (Civil Engineering).
