MOHENDRA SINGH AND OTHERS Vs. STATE

JUDGEMENT

(1.) -The then Vth Addl. Sessions Judge, Bulandshahr vide his judgment and order dated 31-8-79 convicted the accused Mahendra Singh and Om Veer Singh on the charges under Sec. 323/34, 324/34 and 325/34 Penal Code and sentenced them to undergo R.I. for a period of 6 months, one year and 15 months respectively under the said heads and further a fine of Rs. 500/7 under Sec. 325/34 Penal Code was imposed. In default of payment of fine, each one of the accused was ordered to undergo further 3 months RI. The sentence were ordered to run concurrently.

(2.) The aforesaid order was passed in S.T. No. 174/78, State Vs. Mahendra Singh and another in the district of Bulandshar. The incident is said to have taken place on 18-9- 76 between 1.30 and 2 PM in the jungle of Aterna, P.S. Pahasu, distt. Bulandshar.

(3.) The prosecution has examined ocular as well as formal evidence and the learned Addl. Sessions Judge, has after threadbare analysis of the same, come to the conclusion that the charges are brought home to the accused.
