JUDGEMENT

(1.) THIS writ petition has been preferred by the Petitioner for a writ of mandamus commanding the Respondents to give effect to orders dated 30 -6 -1984 and 15 -7 -1984 by which the Petitioner was promoted and posted as Inspector by Respondent No. 2, Deputy Inspector General of Police, U.P. Allahabad, and to post the Petitioner as Circle Inspector in accordance with the approved list of Inspectors dated 30 -6 -1984. It was further prayed that the Respondents be directed by a writ of mandamus to give all benefits, seniority, payment of salary and back wages etc.

(2.) I have heard learned Counsel for the Petitioner and learned Standing counsel appearing for the Respondents at length and perused the papers on record.

(3.) THE Petitioner was working as Sub Inspector in U.P. Civil Police. After certain length of service the Petitioner was considered for promotion to the post of Circle Inspector in the year 1984. A selection committee duly constituted for the purpose had found the Petitioner suitable for promotion and has recommended the promotion of the Petitioner. In pursuance of the recommendation the Petitioner was actually promoted to the post of Circle Inspector. The posting order was issued on 30 -6 -1984. Subsequently the promotion and posting orders were withdrawn by subsequent order dated 15 -7 -1984 on the ground that some enquiry was pending against the Petitioner.
