JUDGEMENT

(1.) These two bail cancellation applications have been filed for cancelling the bail granted to Suresh Kumar @ Suresh Sagar son of Mahipal, Somveer son of Mahipal by Judicial Magistrate, Khair, Aligarh on 10/8/2023 in Bail Application No. 472 of 2023 and also cancelling the bail application of Gaurav Kumar son of Mahipal who was also granted bail by Additional District Judge, Court No. 16, Aligarh on 21/10/2022 in Bail Application No. 6170 of 2022 in Case Crime No. 0525 of 2022, under Sec. 384, 354-B, 504, 506 of I.P.C. and 67-A of I.T. Act, P.S.-Khair, District-Aligarh.

Both the bail cancellation application No. 838 of 2023, which has been filed for cancelling the bail granted to Suresh Kumar @ Suresh Sagar and Somveer, and bail cancellation application No. 840 of 2023 filed for cancelling bail of Gaurav Kumar were heard together. The case was taken up in revised call but no one appeared on behalf of the accused Suresh Kumar @ Suresh Sagar, Somveer and Gaurav Kumar despite the fact that vakalatnama on their behalf has been filed by two counsels namely Ms. Reena Pal, Advocate (A/R-0140/2021) and Sri Adarsh Srivastava, Advocate (A/A- 0020/2016).

The prosecution story as unfolded from the First Information Report is that applicant who is informant had lodged the First Information Report against accused Suresh Kumar @ Suresh Sagar, Somveer and Gaurav Kumar under Sec. 384, 504, 506 of I.P.C., alleging that these three persons for last three months were harassing and blackmailing her daughter. They were threatening to upload her nude photographs on the social media in case Two Lacs Rupees was not given. When the said fact came into the knowledge of the informant he went to the house of the accused, who threatened the informant and demanded money. The three accused were sending vulgar messages on the Mobile No. i.e. 9837969193 of the informant. The said messages were sent from Mobile No. 8218903798. On 23/9/2022 and thereafter on 24/9/2022 again nude photographs of the daughter of the informant were sent not only on the mobile of the informant but also on the mobile of his brother-in-law, Bhupendra Singh.
