JUDGEMENT

(1.) HEARD Sri H. P. Dubey, for the petitioner and Sri Ashok Kumar Pandey, for the respondents.

(2.) THE writ petition has been filed for quashing the order of Secretary, Allahabad Development Authority, dated 21.07.2000, dismissing the petitioner from service.

(3.) THE petitioner was appointed on class IV post on daily wage basis in Allahabad Development Authority on 01.12.1981. The petitioner was regularized on his post on 28.02.1994. Since the date of appointment, the petitioner was discharging his duties and there had been no complaint against him. The petitioner was transferred to camp office of Vice Chairman from Legal Section, by the order of Joint Secretary, by letter dated 06.07.1999. It is alleged that the letter was served to the petitioner on 06.07.1999 but he did not report for duty at camp office, on 07.07.1999. On 07.07.1999, he signed the Attendance Register in Legal Section. Thereafter, he absented from duties without any information up to 04.09.1999. On 09.08.1999, he filed an application for grant of medical leave from 07.07.1999 to 31.07.1999.
