JUDGEMENT

(1.) HEARD Mr.Upendra Nath Misra, learned Counsel for the petitioner, Mr.Anuj Kudesia, learned Counsel for the Urban Cooperative Bank Limited, Mr. Rajesh Singh Chauhan, learned Counsel for Shawal Kumar Gupta and learned Standing Counsel.

(2.) THROUGH writ petition No.1553 (SB) of 2004, the petitioner has assailed the validity of the order dated 28.9.2004 passed by the opposite party No.5/Deputy Registrar, Cooperative Societies whereby opposite party No.6/Shawal Kumar Gupta was given the officiating charge as Secretary of the Urban Cooperative Bank Limited. Further, he also assails the validity of the consequential order dated 29.9.2004 passed by the opposite party No.3/ Chairman, Urban Cooperative Bank Limited, pursuant to the order dated 28.9.2004 passed by the Deputy Registrar.

(3.) GRIEVANCE of the petitioner is that though he is senior to Shawal Kumar Gupta, yet he has been denied promotion on the post of Secretary of Urban Cooperative Bank Limited.
