JUDGEMENT

(1.) HEARD learned counsel for the petitioners, Sri M.K. Kushwaha learned counsel appearing for respondents No.2 and 3 and learned Standing Counsel appearing for respondents No.1, 4 and 5. No notice is issued to respondent No.6 in view of the order which is being passed, however, liberty is reserved for respondent No.6 to apply for variation or modification of this order if he feels so aggrieved.

(2.) BY this writ petition, the petitioners have prayed for a writ of mandamus commanding the respondents not to interfere in the peaceful possession of the petitioners' plot no.892 area 1 biswa of each of the petitioners in village Gunaura, Pargana Kantit, Tehsil Sadar, District Mirzapur.

(3.) PETITIONERS ' case in the writ petition is that petitioners are recorded tenure holder of the aforesaid land. It is submitted that respondents No.2 and 3 are proposing construction of railway overbridge.
