JUDGEMENT

(1.) THIS second appeal is preferred against the judgement dated 3.2.1989 passed in Civil Appeal No.190 of 1984 arising out of judgement dated 31.8.1984 in Original Suit No.127 of 1983.

(2.) THE brief facts, which give rise to this appeal are that the plaintiff -respondent (hereinafter referred to as the "respondent") filed Original Suit No.127 of 1983 against the defendant -appellant (hereinafter referrred to as the "appellant") for the relief of permanent prohibitory injunction restraining the appellant from making any Rasta in the disputed land and interfering in the plaintiff's possession.

(3.) THE suit was decreed by the trial court vide order dated 31.8.1984.
