JUDGEMENT

(1.) WE have heard learned counsel for the petitioner. Learned Standing Counsel appears for the State respondents.

(2.) THE petitioner was running a fair price shop, which was cancelled on the ground of irregularities and which were found substantiated in the order dated 18.9.2013. The petitioner filed an appeal no.251/G/2013 before the Commissioner, Gorakhpur Division, who stayed the settlement of fresh shop until 12.12.2013. On 17.12.2013 the interim order was not extended on which the respondents have initiated proceedings to settle the shop afresh.

(3.) IT is admitted to the petitioner that stay order was not extended on the previous date after which the proceedings for settlement of shop were initiated.
