JUDGEMENT

(1.) BY means of present writ petition, the petitioner is seeking a writ in the nature of certiorari for quashing the impugned notice dated 03.02.2014 issued by Principal, K.N. Grover Nehru Post Graduate College, Gola Gokrannath, District -Lakhimpur Kheri, by which the petitioner has been informed about his superannuation on attaining the age of 62 years on 30.06.2014. Petitioner is further seeking a writ in the nature of mandamus for commanding the State Government and Special Secretary (Higher Education) Higher Education Section - 2, Government of U.P., Lucknow to do needful in the matter and take appropriate decision for enhancement of age of superannuation of teachers of Colleges/Universities from 62 to 65 years, in the interest of justice. Petitioner is also seeking a writ in the nature of mandamus for commanding the Manager and Principal of K.N. Grover Nehru Post Graduate College, Gola Gokrannath, District -Lakhimpur Kheri to allow the petitioner to continue in service upto 65 years, in the interest of justice.

SHRI Badrul Hasan, learned Additional Chief Standing Counsel raised a preliminary objection with respect to maintainability of present writ petition on the ground that the issue has already been decided by the judgment and order passed by Hon'ble Apex Court in Civil Appeal Nos. 5527 -5543 of 2013 (Jagdish Prasad Sharma Etc. Etc. Vs. State of Bihar and others) and a bunch of writ petitions, consisting 124 writ petitions, has also been disposed of in terms of ratio laid down by Hon'ble Apex Court. The relevant portion of the Judgment and order passed by Hon'ble Apex Court in Civil Appeal Nos. 5527 -5543 of 2013 reads as under:
