JUDGEMENT

(1.) Supplementary affidavit filed today by learned counsel for the applicant is taken on record.

(2.) The present matter has come up before this Court after a nomination by Hon'ble The Chief Justice vide order dated 14.7.2014 in pursuance of a judicial order passed by another Bench of this Court on 10.7.2014 which is quoted hereinbelow:-

The present 482 Cr.P.C. has been filed praying for setting aside the order dated 2.6.2014 passed by IInd Additional Chief Judicial Magistrate, Ghaziabad in Complaint Case No. 1086 of 2009 under Sections 403, 405, 423, 120-B/34 I.P.C. dismissing the application moved by the applicant under the provisions of Section 205/317 Cr.P.C. to exempt the applicant from personal appearance.
