JUDGEMENT

(1.) HEARD the learned counsel for the parties and having perused the material placed on record.

(2.) THE petitioner, had been a bidder in the auction proceedings conducted by Awas Evam Vikas Parishad on 04.07.2014 for sale of commercial plots at Lohiyapuram Yojana, Fatehgarh, District Farrukhabad and had offered an amount of Rs. 20,700/ - per square metre for plot No. 4/32 -C as against the reserved price of Rs. 19,712/ - per square metre. However, the respondent No. 3 - Deputy Housing Commissioner, Kanpur Zone has not accepted the offer so made and has ordered for re -auction by his impugned order dated 05.08.2014. Aggrieved, the petitioner has filed this writ petition.

IT is pointed out that the plot in question was earlier also put to auction and as against the reserved price of Rs. 15,053/ - per square metre then fixed, the highest bidder, of course, offered the bid at Rs. 37,000/ - but did not deposit the requisite amount and hence, his offer stood cancelled.
