JUDGEMENT

(1.) Heard Sri Sushil Kumar Shukla, learned counsel for the petitioner.

(2.) This writ petition has been filed for issuing a writ of certiorari quashing the orders dated 9.9.2011 passed by the Additional District Judge, Court No. 2, Ghaziabad in SCC Suit No. 11 of 2007 (Smt. Kamlesh Kumari and another Vs. Sanjeev Tyagi) as well as the order dated 13.4.2012 passed by the same learned Judge.

(3.) Vide order dated 9.9.2011, suit filed by the respondents has been decreed. Whereas by the subsequent order dated 13.4.2012, the petitioner's application, filed under Order 9, Rule 13 of Code of Civil Procedure (in short 'C.P.C.') along an application to condone the delay under Sec. 5 of Limitation Act, has been rejected.
