JUDGEMENT

(1.) WRIT Petition No. 333 (S/B) of 2010 has been filed by Shiv Shanker Ram for quashing of the orders dated 28 January 2010 passed by the respondent no. 1 wherein respondent no. 3 has been promoted on the post of Director, Technical Education, U.P., Kanpur on the basis of recommendations made by the Departmental Selection Committee and petitioner has also challenged the validity of the order dated 28 January 2010 passed by the respondent no. 1 wherein respondent no. 4 has been promoted on the post of Director, Institute of Research, Development & Training, U.P., Kanpur and petitioner has also challenged the validity of the order dated 16 February 2010 passed by the respondent no. 1 wherein respondent nos. 5 and 6 have been promoted on the post of Additional Director, Technical Education, U.P.

(2.) WRIT Petition No. 646 (S/B) of 2012 has been filed by Ram Charan Rajput with the same prayer of quashing of promotion order dated 28 January 2010 and 6 April 2010 in reference of respondent no. 4 Sri Madhukar, Director, Technical Education, U.P., Kanpur and Sri Om Prakash, Director, Institute of Research, Development and Training, Kanpur and further for commanding the respondents to accord promotion to him on the post of Director, Technical Education w.e.f. 28 January 2010, the date when Smt. Sushma Gaur has been promoted and allow all consequential service benefits arising out of it.

BRIEF background of the case as is emanating that a vacancy of Director, Institute of Research, Development and Training, U.P. arose in the department of technical education on 30 June 1998 and a vacancy of Additional Director, Institute of Research, Development and Training, U.P., arose on 29 July 1998 and on account of promotion of Usha Birji to the post of Director, Technical Education from the post of Additional Director, a vacancy of Additional Director arose in the department on 4 November 2003 and Usha Birji retired from the post of Director, Technical Education on 31 January 2008 and, accordingly, post of Director fell vacant, thus two posts of Director and two posts of Additional Director were vacant in the department concerned.
