JUDGEMENT

(1.) HEARD Sri Kirtikar Pandey, learned counsel for the petitioner, Sri Satya Priya Upadhayaya, learned counsel appearing for respondent no.7 and the learned Standing Counsel appearing for the State -respondents. Sri K.S.Kushwaha, learned counsel has put in appearance on behalf of the Basic Shiksha Parishad.

(2.) THE dispute in this writ petition is with regard to selection and appointment of Shiksha Mitra in a Basic School, namely, Abdulpur Madari No.1, Block Nagla, Tehsil Rasra, District Ballia.

(3.) AN advertisement was issued for appointment of Shiksha Mitra on 25.7.2005. In all 14 applications were filed. The Village Education Committee after assessing their quality point marks prepared a merit list which is filed as Annexure -2 to the writ petition. In the said merit list respondent no.7 -Shashi Bhushan Singh obtained 67.86% marks. Rakesh Singh, who is at serial no.2 has obtained 64.84% marks and the petitioner -Hare Krishna Singh obtained 63% marks. One Anand Kumar, who is at serial no.4 in the list, obtained 61.8% marks.
