(2.) BY means of this writ petition, the petitioner -employer is challenging the order of the Central Government Industrial Tribunal, Kanpur dated 31.10.1995 passed under Section 33C(2) of the Industrial Disputes Act, 1947.
(3.) THE Respondent No.1 herein, was employed as a Guard in the Indian Railways. He is said to have worked overtime from 22.1.1984 to 22.6.1985. According to the learned counsel for the petitioners, as per Section 71(c)(4) of the Railways Act, the respondent -workman was entitled to overtime wages but as the same were not paid, therefore, he filed an application before the Tribunal claiming Rs.62991.35 as the wages referred above giving the details thereof in the Schedule attached to the application.
